Writ of Possession/Orders of Possession

To avoid any confusion with Writs of Possession/Orders of Possession, please use the following as a guide.

You will need a total of two (2) Sheriff Service Process Receipt completed and signed for each case.

The required deposit is $250.00 (effective 11/16/15), which needs to be in the form of an attorney check, bank check, money order or cash. The draft should be made payable to the Sheriff of Monroe County.
 
The Writ of Possession will be served personally/person in charge, unless directed otherwise by Court Order.
A notice of ten (10) days will be given to vacate the premises unless there is a Court Order indicating less time. You will need to have someone present at the time of eviction to meet the deputies. We do not padlock, change locks or arrange for moving/storage of personal belongings left behind by the Defendant(s) so you may want to have a locksmith and mover available for the recheck.
 
Also, be advised that we will now require that box #8 Posting Requirement on the Sheriff Service Process Receipt be completed. You must provide a tax code and pin number in order for service to be made. 
 
Act 32 of 2018 Vacant and Abandoned Real Estate Foreclosure Act (effective 12/2018) – Pursuant to this new act please be advised that any Writ of Possession that falls under this act must also include an additional expedited fee of $250.00 as well as the Certification Pursuant to Act 32 of 2018 Expedited Lockout Fee form.

An Order for Possession originating from the District Court will be served or posted as directed by the Order. The defendants are given 10 days to vacate the property (15 days for businesses) or pay the total amount due on the Order, plus Sheriffs costs, unless the Order solely grants possession. The Plaintiff is REQUIRED to provide a good telephone number in order for our office to contact them with the eviction date and time.  The plaintiff will need to have someone present at the time of eviction to meet the deputies. We do not padlock, change locks or arrange for moving/storage of personal belongings left behind by the Defendant(s) so you may want to have a locksmith and mover available for the recheck.
